Obituary taken from the French Broad Hustler paper Thursday 12 April 1906:
Mr. David Osteen died at his home at Mt. Olive [Olivet], after a long spell of sickness. Mr. Osteen was the father of thirteen children, nine are living and four dead. He was sixty-five years and nine months old.
Mr. Osteen lived a Christain life and was loved by everybody. His remains were laid to rest in Mt. Olive cemetery April 6th.

To the Superior Court of Henderson County:
In obedience to an order of the Superior Court of Henderson County, appointing the undersigned as Commissioners to allot to the widow Nancy C. Osteen widow of D. N. Osteen her dower in the lands described in the petition in this case and to partition among the other heirs, tenants in common their shares in said hand. We _____ to report; that on the 20th day of July 1907, after having been duly sworn by M. _ . Vaughn, as Justice of the peace of Henderson County, we proceeded; first to allot to the said widow, her dower which is marked as accompanying plot as "Dower Tract" and is fully described herein after by meters and bounds and that we proceeded to allot to each of the heirs and tenants in common their shares, as is indicated on said plot and hereinafter fully described by meters and bounds.

vs. Decree Confirming Commissioners
Gustavies Hart, et, al Report

We, appearing to the Court that T. C. Anderson and J. S. Patterson and A.H. Capps Commissioners heretofore appointed by the Court to divide the lands described in the petition in this cause among the tenants in common therein named and allot to each his share in severalty, filed his upon in this Court on the 4th day of September, 1907, and specifying therein the manner of executing the trust and describing particularly the parcels of land divided and the share allotted to each tenant in severalty together with the allotment of dower to widow and no objection being filed by the parties and therein the twenty days allowed by ----- from the filing of said report.

It is therefore decreed by the Court that the said report be, and the same is hereby in all respects confirmed, and it is further ordered that said report be enrolled in the records of this Court and that the same together with this decree be certified to the register of deeds for Henderson County, to the end that he may record the same in his office.

The said decree is hereby adjudged to be binding between the said tenants in common and the widow Nancy C. Osteen as to the dower their hiers and assigns. It is also adjudged that the costs of this proceedings be paid by the parties, No 1 as follows, each party including the widow to pay the fraction 1/11 of the cost except that T. E. Osteen shall pay 2/11. He owning 2 shares.
That the following items shall be taxed in the bill of cost and allowed to C. F. Toms attorney $40.00 to the guardian ad li term ---- $3.00 to T. C. Anderson surveyor and allowance of $1.00 for surveying and plating the land.
